Nintendo has summoned the wrath of the US government. The USPTO has ordered a reexamination of Nintendo’s Patent No. 12,403,397, which covers summoning a subcharacter to fight in one of two modes—essentially the heart of Pokémon mechanics. Director John A. Squires is overseeing it, challenging the patent’s validity due to prior art, amid the fallout from Nintendo’s suit against Pocketpair over Palworld’s similar features. The process should wrap up around January 2026, and it might shake up Nintendo’s approach to IP in gaming. Gamers have been watching this one closely.
